My search also left me with “The Bonnie Blue Flag” running through my head for much of that afternoon, thanks to this page.. A variant on this assertion, to the effect that, “the majority of justices on the U.S. Supreme Court at that time acknowledged the right of secession”, can be found here.. See C. A Constitutional History of Secession Hardcover – Octo The author makes a strong case for the legality of the secession of the southern states and the illegality of the Civil War, things not mentioned in any history class I ever took.

A secession referendum was held on 8 April in the Australian state of Western Australia, on the proposal that the state withdraw from the Australian Federation.

The proposal won a majority of the votes and a petition to give effect to the decision was subsequently sent to the British Parliament, where a parliamentary joint select committee ruled it invalid.

Eventually the case for secession was rejected by the UK Parliament and the Western Australian secession movement died away, certainly overtaken by the events of World War 2.

But since the referendum murmurings about Western Australian secession occur from time to time, especially when there are perceptions that WA may be getting a ‘raw deal’ from the Federal government in Canberra. Full text of "Mississippi Law Journal Apr. Book 4" See other formats.

"Lawful, fair secession referendums are an act of statecraft. Different countries do them differently. In the UK we do them by agreement. Here, it's not for one side unilaterally to demand a secession referendum.

Timing, and other matters, 1932 proceed by agreement. Accordingly, the secession of Quebec from Canada cannot be accomplished by the National Assembly, the legislature or government of Quebec unilaterally, that is to say, without principled negotiations, and be considered a lawful act.

Any attempt to effect the secession of a province from Canada must be undertaken pursuant to the Constitution of Canada, or else violate the Canadian. The Right of Secession. by Gene Kizer, Jr. There is no evidence that secession was illegal or prohibited by the Constitution, and in fact there is almost overwhelming evidence to the contrary, that secession was a legal, constitutionally sanctioned act.

The secession of a single State would be suicidal; it would be surrounded with custom-houses, cramped with restrictions, and crushed under the expenses involved.

North Carolina and Rhode Island, after refusing to join the Union, and holding out for more than two years, were at last constrained to accede, by the same causes which will always. IIRC, unionists in the Georgia secession convention tried to get a referendum requirement before secession but failed.

I think it speaks to the overall weakness of the secession cause that advocates of it were afraid to take it to the electorate in the deep South. The justification for the Union in prosecuting the war was simply that secession was illegal and treasonous. It required no deeper principle.

It is the Southern states that required deep. Secession in is not premature, impractical, nor against the law. The time is right for separation and the establishment of local self-rule for all peoples who desire to be free. Secession has long been seriously debated in several western States and in Canada.

The information for this map came from the reported voting results on Virginia's Ordinance of Secession, which was put to public vote onalthough some of those results had to be reconstructed by Richard O.

The Secession Commissioners and Their Reasons for Secession In the winter leading up to the outbreak of the Civil War, the South had begun to preach a secessionist message. Commissioners were sent from Mississippi, Alabama, South Carolina, Georgia, and some from Louisiana to preach the secessionist message to other southern states (Dew, 18).

Only thirteen chapters, it was translated first in when a French Jesuit priest living in China, Joseph Amiot, acquired a copy of it, and translated it into French.

Subsequent translations have honed the text into English. Furthermore, since the act of treason, according to the Constitution, relates to the individual States, not the federal government, those in the South defending their homeland during the Civil War most certainly did not perpetrate any acts of treason.

The reality of the actual secession is quite different. Secession was the act by which a state left the Union. The Secession Crisis of late and early led to the Civil War when southern states seceded from the Union and declared themselves a separate nation, the Confederate States of America.

There is no provision for secession in the U.S. Constitution. “You assist an evil system most effectively by obeying its orders and decrees. An evil system never deserves such allegiance.

Allegiance to it means partaking of the evil. A good person will resist an evil system with his or her whole soul.” ~ Gandhi It seems to be a forgone conclusion that American society, within a short period of time, will face a complete breakdown of its consumer culture.
